1. Acceptance of Terms & Scope of Services

By accessing, browsing, or utilizing the Enigma Earth platform (the “Platform”) or submitting technical project data, buyer requirements, or mineral supply information, you agree to comply with and be bound by these Terms and Conditions.

The Platform provides technical mineral specifications, provincial concession summaries, geological exploration context, and private intake portals to assist commercial participants. All services are provided subject to formal technical scoping and mutual agreement.

2. The Evidence Baseline: Mineral Occurrence ≠ Commercial Production

Users must recognize and respect Enigma Earth's fundamental operational baseline:

• Geological Occurrence ≠ Mineral Reserve: The geological presence of a mineral occurrence, outcropping, or historical working does not establish an economic or compliant mineral reserve.
• Historical Extraction ≠ Active Supply: Historical artisanal extraction or previous tender notices do not guarantee active stockpiles or current production capacity.
• Auction Notice ≠ Resource Guarantee: Provincial concession auction notices reflect statutory licensing procedures and do not constitute certified or verified commercial mineralization.
• Independent Verification Required: All commercial transactions require independent laboratory assay testing (e.g., ISO/ASTM accredited laboratories), site visits, and title confirmation.

3. User Submissions & Submitter Warranties

When transmitting data through our intake portals (including “Sell Your Mineral”, “Mineral Buyers”, or “Submit a Mining Project”), you warrant and represent that:

• All information provided regarding corporate identity, licence numbers, coordinates, assays, and commercial terms is accurate, truthful, and not misleading.
• You are either the direct title/concession holder or an authorised representative holding a documented legal mandate to submit the information.
• You hold the full legal right and authority to disclose all attached documents, geological maps, drill logs, and reports without violating third-party confidentiality agreements or statutory restrictions.
• You understand that intake submission does not guarantee verification, platform publication, partnership introduction, or funding.

4. Non-Circumvention & Bilateral Conduct

Where Enigma Earth facilitates confidential technical diligence or structured introductions between project owners, verified buyers, or joint venture partners, participants agree to conduct discussions in good faith and adhere to standard commercial non-circumvention practices.

5. Limitation of Liability & Governing Law

To the maximum extent permitted by applicable law, Enigma Earth, its officers, directors, and technical personnel shall not be liable for any indirect, incidental, or consequential damages resulting from reliance on public summaries, tender gazettes, or private intake assessments.

These Terms and Conditions shall be governed by and construed in accordance with the substantive laws of the Islamic Republic of Pakistan. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the competent courts in Pakistan.
